American owners lose in court again

Liverpool’s American owners, George Gillett and Tom Hicks, have lost their latest battle in the High Court.   Mr Justice Floyd described their conduct as ‘unconscionable’ which is pretty strong language for a judge to use.

For the club, Lord Grabiner QC was dismissive about ‘that famous jurisdiction, the Dallas County Court.’   ‘We say the proceedings brought in Dallas are abusive, vexatious and oppressive,’ he said. ‘Having lost in front of your lordship they simply went to another jurisdiction to resume the same debate.’


The judge ruled that their Texan injunction had no validity in England.   The judge declared, ‘This case has nothing to do with Texas.’  Of course, we always knew that and what worried Royal Bank of Scotland and the other parties was the possibility of contempt of court actions in the States which would damage their businesses there.


It’s now 2-1 to the club with time added on looming.   Hicks and Gillett are now running out of options and the time may have come to stop running up legal bills and accept defeat which as much grace as they can muster.
